Q & A HALACHA
FAST OF TEVES
Is it permissible to wake up early before the fast begins to eat & drink?
- The 16th century author of the Shulchan Arukh, Rav Yosef Cairo writes that all
communal fasts which do not start at night, begin at Dawn (Olot Ha’Shachar). - However, he notes that if one were to go to sleep before Dawn (Olot Ha’Shachar),which
people usually do, then the fast sets in right away & one would not be permitted to wake
up early to eat & drink. - If one were to stipulate before going to sleep though, that they plan on waking up early to
eat & drink then it would be permissible to do so (OC 564:1). - The 16th century Ashkenazik halakhic authority the Rema argues & states the
stipulation would only be necessary for the eating, however one is always permitted
to wake up early to drink. - The Mishna Brura, authored by Rav Yisrael Meir Ha'Kohen Kagan (1839- 1933)
explains that although the Rema is correct, it is still preferable for one to make a
stipulation for both eating & drinking (564:6).
